Accessing the Legislation
The taxing and borrowing provisions of the FSMA are available to only those First Nations that appear on the Schedule to the Act. In order to be placed on the Schedule, the council of an interested First Nation should submit a request to the

The request must be accompanied by a Band Council Resolution indicating that the First Nation wishes to be placed on the Schedule.
The Minister will then recommend to the Governor in Council that the name of the First Nation be added to the Schedule.
Requests may be submitted at any time.
First Nations that are not "bands" as defined by the Indian Act may still benefit from the taxing and borrowing provisions of the FSMA. These First Nations would be brought under the legislation through the development of a regulation made under section 141 of the FSMA. These regulations, which will be developed in consultation with the First Nation and the institutions established by the FSMA, would adapt the provisions of the FSMA, as required, to allow the First Nation to participate in the taxing and borrowing regimes.
Such First Nations should submit a local government resolution indicating that the First Nation wishes to come under the provisions of the First Nations Fiscal and Statistical Management Act to the Minister of Indian Affairs at the above address.

General
A First Nation does not have to be on the Schedule or have a regulation developed to benefit from the property taxation advisory services provided by the First Nations Tax Commission, the financial management advisory services provided by the Financial Management Board or the statistical services provided by the Statistical Institute. These services are available to all First Nations.
